Terms and Conditions
1. PAYMENT:
No rights are granted unless and until photographer has received full payment. Any use prior to full payment will be considered an unauthorized use.
Invoices are due upon receipt (Unless stated otherwise). Adjustments of amounts or terms must be requested within ten days of invoice receipt.

Photographer does not provide any receipts to Client. Photographer’s invoice will serve as Client’s receipt for work performed and services rendered.

Brenda Biro Photography is owned and operated by Brenda Biro. Please make all payments payable to Brenda Biro
​
A 50% deposit is required from the client upon accepting an estimate (Unless stated otherwise), the client also automatically agrees to the terms and conditions.

Payments can be made throughout PayPal, iDeal and bank transfer.
2. CANCELLATIONS and POSTPONEMENTS:
Once Client and Photographer have agreed to time(s) and date(s) for a photography assignment, Photographer will not accept work from any other client for the same time(s) and date(s).

Where Client postpones or cancels an assignment, Client will pay all expenses incurred by Photographer up to the time of postponement or cancellation, plus all fees for any subcontractors booked for the assignment, and:
(a) Fifty percent (50%) of Photographer’s fees for postponement, or cancellation, less than twenty-four hours from the scheduled time, or
(b) One hundred percent (100%) of Photographer’s fees for postponement, or cancellation, after Photographer has departed for location.

Fees for cancellation or postponement will apply irrespective of the reasons for the cancellation or postponement. However, Photographer understands that life doesn’t always happen as planned and consideration will be given in any such circumstance.

3. FAILURE TO PERFORM:
If Photographer is unable to supply their photographic services due to illness, mechanical breakdown, accident, acts of God, or any other cause beyond his control, Photographer will return any fees paid by Client and will have no further liability with respect to this Agreement, and Photographer will not be responsible or liable for any other damages beyond the amount of this Agreement.

4. MATERIALS, COPYRIGHT & CLIENT USE:
All photographic materials, such as original negatives, photos, or slides, shall be the exclusive property of the Photographer. The Photographer shall own the copyright in all images created and may use the work for samples, contests, exhibition, advertising and self-promotion.
Usage outside the bounds of this agreement will require the Client’s consent.

The Client is obtaining prints for personal use only, and shall not sell said prints or authorize any reproductions thereof by parties other than the Photographer

5. SOCIAL MEDIA:
This clause applies to all social media, including Facebook and blogs. When published online it is required that citation of photographer be made.
The client agrees that they will under no circumstances alter any photographs that are placed in public on the internet. The client agrees to be responsible for any family member or friend who posts our photographs online and agrees that they cannot be cropped (with the exception of the forced cropping for Facebook’s Timeline), altered in color, or edited in any way.

6. EDITING:
Client accepts that all photographs will be taken and edited at the photographer’s discretion based on the photographer’s experience and artistic view.

It is understood that Photographer is not responsible to fix photos to cover parts of your body that you do not wish to be seen in the photo, unless it was confirmed with the photographer in writing.
